Terms and Conditions of Sale

This English version is provided for convenience. These terms are governed by French law and, in the event of any discrepancy, the French version prevails.

Article 1 - Purpose

These terms and conditions of sale govern the contractual relationship between Braza Scent (hereinafter "the Seller") and any natural or legal person (hereinafter "the Customer") wishing to make a purchase via the website brazascent.com.

Article 2 - Products

The products offered for sale are authentic perfumes decanted into small quantities (2ml, 5ml, 10ml). Each product comes with a detailed description enabling the Customer to know its essential characteristics.

Product photographs are not contractual and cannot engage the Seller's liability.

Article 3 - Prices

Prices are shown in euros, including all taxes (VAT included). They do not include delivery costs, which are charged in addition as specified when ordering.

The Seller reserves the right to change its prices at any time, it being understood that the price applied will be the one in force when the Customer confirms the order.

Article 4 - Orders

The Customer places an order by following the online ordering process. The sale is concluded as soon as the Customer's payment is confirmed. A confirmation email summarising the order is sent to the Customer.

The Seller reserves the right to refuse or cancel any order from a Customer with whom there is a dispute concerning the payment of a previous order.

Article 5 - Payment

Payment is made online by bank card (Visa, Mastercard, American Express) via the secure Stripe platform. Apple Pay and Google Pay are also accepted.

Payment is due immediately upon ordering. Payment data is encrypted and never passes through our servers.

Article 6 - Delivery

Products are delivered to the address given by the Customer when ordering. Delivery times are given as an indication:

• Standard delivery: 3 to 5 working days
• Express delivery: 1 to 2 working days

Standard delivery is free on orders over €69. Below that amount, a €5.90 fee applies. Express delivery costs €12.90.

In the event of a delivery delay, the Customer will be informed as soon as possible.

Article 7 - No right of withdrawal

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to products sold by Braza Scent.

Our perfumes are decanted products, prepared individually for each order. These products cannot be returned for reasons of hygiene and health protection, in accordance with Article L.221-28 3° of the French Consumer Code, which excludes from the right of withdrawal:

"The supply of sealed goods which were unsealed by the consumer after delivery and which are not suitable for return due to health protection or hygiene reasons."

Consequently, no returns or refunds will be accepted. The Customer is informed of this condition before confirming the order. For more information, see our Returns policy.

Article 8 - Warranties

All our products benefit from the legal guarantee of conformity (Articles L.217-4 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).

If a product is non-conforming or defective, the Customer may request its replacement or a refund.

Article 9 - Liability

The Seller cannot be held liable for non-performance of the contract in the event of force majeure, disruption or total or partial strike of postal services and means of transport, or in the event of an unforeseeable stock shortage.

Article 10 - Intellectual property

All elements of the brazascent.com website (texts, images, logos, etc.) are the exclusive property of the Seller. Any reproduction, representation or use, in whole or in part, is prohibited without prior authorisation.

Article 11 - Personal data

The information collected when ordering is processed electronically for order management and customer relations. For more information, see our Privacy policy.

Article 12 - Mediation

In the event of a dispute, the Customer may use the consumer mediation service free of charge. The mediator will try to find an amicable solution to the dispute. For more information on mediation, see the official website: economie.gouv.fr/mediation-conso.

Article 13 - Applicable law

These terms and conditions of sale are governed by French law. In the event of a dispute, the French courts alone shall have jurisdiction.
